1. Acceptance of These Terms
Welcome to Snapomi ("Snapomi" or the "App"), provided by MindifyScape Technology Co., Ltd. ("we," "us," or "our").
By downloading, installing, accessing, or using Snapomi, you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, please do not use Snapomi.
If you have not reached the age at which you may independently agree to these Terms under the laws of your country or region, you should use Snapomi only with the consent and supervision of a parent or legal guardian.
2. The Snapomi Service
Snapomi is a digital collection app for capturing, organizing, and displaying real-world objects. Depending on your version and device, features may include:
- taking photos or importing images from your device photo library;
- automatically identifying and extracting subjects from images;
- turning extracted subjects into digital stickers or collectibles with visual effects such as outlines and shadows;
- adding text or text stickers;
- creating, editing, and organizing albums, booklets, or other collection displays;
- exporting or sharing creations using sharing features provided by your device; and
- other related features that we may make available from time to time.
Features may vary by platform, device, operating system version, region, or App version.
3. License to Use Snapomi
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license for personal use of Snapomi on compatible devices that you lawfully own or control.
Except where expressly permitted by applicable law, you may not copy, sell, rent, distribute, sublicense, reverse engineer, decompile, attempt to derive the source code of Snapomi, or create unauthorized derivative works from the App.
If you obtain Snapomi through a third-party app store such as the Apple App Store or Google Play, your use may also be subject to that store's license and usage rules. Mandatory platform-specific terms will control with respect to platform-specific matters.
4. Intellectual Property
Snapomi, including the software, interface, design, graphics, trademarks, names, icons, and other materials provided by us, is owned by us or the applicable rights holders and is protected by applicable intellectual property laws.
These Terms grant you only a limited right to use Snapomi and do not transfer ownership of any intellectual property in the App to you.
5. Your Content
"Your Content" means photos, images, stickers, text, albums, booklets, and other content that you capture, import, create, or edit using Snapomi.
You retain the rights you lawfully hold in Your Content. We do not acquire ownership of Your Content merely because you use Snapomi.
You represent that you own or have the necessary rights and permissions to use Your Content and that your use, editing, storage, or sharing of Your Content will not infringe another person's copyright, trademark, privacy, publicity, portrait, or other legal rights.
To the extent technically necessary to provide features you choose to use, you permit Snapomi to process Your Content, including by reading, cropping, extracting subjects, rendering, storing, or exporting it. This permission is limited to what is necessary to provide and maintain the functionality you request.
If you send Your Content to a third-party app or service using system sharing features, further processing by that third party is governed by its own terms and privacy policy.
6. Automated Image Processing
Snapomi may use automated technology to identify or extract subjects from photos. Results may be incomplete, inaccurate, or different from what you expect because of image quality, background, lighting, occlusion, device capabilities, or other factors.
You should review the result before relying on it for important purposes or using it for publication, printing, or commercial purposes. We do not guarantee that automatic subject detection, cutout, or other image processing will be completely accurate in every situation.
7. Prohibited Conduct
You may not use Snapomi to:
- engage in unlawful, fraudulent, infringing, harassing, threatening, or abusive conduct;
- process or share content you do not have the right to use;
- violate another person's intellectual property, privacy, publicity, portrait, or other legal rights;
- introduce malicious code or disrupt, interfere with, or circumvent Snapomi's security, technical restrictions, or normal operation;
- access Snapomi, our systems, or another person's data without authorization; or
- use the App in violation of applicable law or applicable app-store rules.
8. Paid Features, One-Time Purchases, and Subscriptions
Some Snapomi features may require payment and may be offered through one-time in-app purchases or auto-renewable subscriptions. The product type, included features, price, currency, billing period, free trial, or promotion, if any, will be as shown in the App and the applicable app store at the time of purchase.
If you purchase an auto-renewable subscription, it will renew automatically at the end of each subscription period unless you cancel it before renewal using the method provided by the applicable app store. Charges, renewals, subscription management, and cancellation are handled through the app-store account you used to make the purchase and are subject to that store's rules.
Canceling a subscription generally prevents future renewals, while access to paid benefits ordinarily continues until the end of the already-paid billing period, subject to the applicable store rules and applicable law.
Refunds, purchase reversals, price adjustments, taxes, and payment disputes are handled under the policies of the applicable app store and applicable law. Nothing in these Terms limits any mandatory refund or consumer rights you may have under applicable law.
We may change future prices or paid offerings as permitted by law. Subscription price changes that require notice or consent will be handled in accordance with applicable app-store rules and applicable law.
9. Third-Party Platforms and Services
Snapomi may rely on operating systems, app stores, photo libraries, cameras, system sharing menus, or other functionality provided by third parties. Those third-party services are independently operated and subject to their own terms and policies.
We do not control third-party services and cannot guarantee that they will always remain available. Changes, interruptions, or discontinuation of third-party services may affect certain Snapomi features.
10. Privacy
Our handling of information in connection with Snapomi is described in the Snapomi Privacy Policy. The Privacy Policy contains important information about matters such as camera and photo-library permissions, local image processing, diagnostic information, and other data practices.
Please review the Snapomi Privacy Policy before using the App.
11. Data Storage and Backups
Some Snapomi content may be stored locally on your device. Uninstalling the App, clearing App data, device damage, system failure, or the absence of an appropriate backup may result in loss of content.
Where Snapomi supports export or system backup functionality, we recommend keeping appropriate backups of important content. Except where applicable law requires otherwise, we cannot guarantee recovery of deleted or lost content that existed only on your device.
12. Changes, Updates, and Discontinuation
We may update, add, modify, or discontinue Snapomi features to improve the product, security, compatibility, compliance, or our operations.
Where reasonably practicable and legally required, we will provide appropriate notice of changes that materially and adversely affect you. Nothing in these Terms excludes rights you may have under applicable consumer protection law.
13. Disclaimers
To the maximum extent permitted by applicable law, Snapomi is provided on an "as is" and "as available" basis. We do not guarantee that the App will always be uninterrupted, error-free, completely secure, or produce fully accurate processing results on every device or image.
Some jurisdictions do not permit the exclusion of certain statutory warranties. In those jurisdictions, the disclaimers above apply only to the extent permitted by law and do not affect non-waivable consumer rights.
14. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, or consequential losses arising from the use of or inability to use Snapomi, or for loss of data, content, profits, or business opportunities, except where liability cannot lawfully be limited or excluded.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, or any other matter that cannot be excluded or limited under applicable law.
15. Suspension and Termination
You may stop using Snapomi and remove the App from your device at any time. Deleting the App does not automatically cancel an active app-store subscription. To cancel a subscription, use the subscription-management method provided by the applicable app store.
If you materially or repeatedly breach these Terms, or where necessary for legal, security, or technical reasons, we may restrict or terminate your access to parts of the service to the extent permitted by applicable law.
16. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where we are established, without regard to conflict-of-laws principles. If mandatory laws in your place of residence provide you with greater protection as a consumer, those mandatory rights are not affected by these Terms.
If a dispute arises, we encourage you to contact us first at support@mindifyscape.com so that we can try to resolve it informally. To the extent permitted by law, disputes may be submitted to courts having jurisdiction where we are established. These Terms do not restrict any right you may have under applicable consumer law to bring a claim in another competent court.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes to our features, legal requirements, or operations. The updated version will be made available through the App, our official website, or another reasonable method and will state a new effective date.
If a change materially affects your rights or obligations, we will provide reasonable notice where required by applicable law. By continuing to use Snapomi after an update takes effect, you accept the updated Terms. Where the law requires separate consent, we will obtain it as required.
18. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a right immediately does not waive that right.
If you downloaded Snapomi from the Apple App Store and Apple's Standard End User License Agreement applies to the App, that agreement applies together with these Terms; for matters that Apple's platform rules require to be governed by that license, the Apple license controls. Apple and other app stores are not the operator of the Snapomi service under these Terms.
